Erin Smith's practice area is devoted primarily to domestic relations, business law, and estate planning and administration. Erin works passionately to help families navigate through challenging and difficult legal circumstances.
Prior to joining The Peninsula Center, Erin served as a law clerk for the James City County Attorney's office. During this time, she gained experience in land use, development, and local government law. She also litigated child abuse and neglect cases for the Department of Social Services in the Juvenile and Domestic Relations Court.
Erin joined Montgomery, Kelley & McKinnon in 2012 as an associate attorney. There, she focused on family law, criminal law, business law, and estate planning and administration. She was regularly appointed by local courts as a Guardian ad Litem for children and incapacitated adults.
Her domestic relations experience includes issues related to divorce, equitable distribution, custody and visitation, child support, spousal support, and adoption. She regularly represents clients at hearings and trials before juvenile and domestic relations courts as well as circuit courts, guiding them through pre-trial motions, and negotiating and drafting settlement agreements.
At The Peninsula Center, Erin focuses on a variety of estate and family law issues, including, but not limited to: wills and trusts, probate and trust administration, guardianships and conservatorships, divorce, adoption, child custody, and business planning.
Erin is a graduate of the University of Mary Washington and she earned her law degree from the Appalachian School of Law. She serves as General Counsel for Court Appointed Special Advocates (CASA), and she is a Court Appointed Special Advocate, a member of the Virginia State Bar, Family Law section, Virginia Trial Lawyers Association, and the Williamsburg Bar Association. She is also an adjunct professor of law with Ms. Mock at the William & Mary Law School Elder & Disability Law Clinic.
